  • When will my child support obligation end?

    The adoption department will complete a Prior Court notice notifying the Friend of the Court upon finalization of the adoption.

  • How long does the process take?

    On average the goal of the court is to have the adoption completed in less than 12 months. Multiple variables will determine how quickly the adoption can be completed. Contact the adoption department for more details regarding your specific case.

  • Do I need an attorney?

    The 17th Circuit Court's goal is to make the adoption process accessible for self-represented litigants; however, depending on the complexity of your case - it may be advisable to seek counsel.

  • Can adoption department staff help me fill out paperwork?

    The adoption department cannot help with filling out paperwork. They are available to assist with questions and can review paperwork for completeness. An appointment is recommended to ensure staff is available. The Legal Assistance Center located at the 17th Circuit Court on the 5 th floor is also available for assistance. Please check their website for up to date hours of operation.

  • What if I don't know where the other parent is residing?

    Reasonable efforts must be determined to be met when locating a parent that is entitled to notice by statute. The court may require a motion and order for alternate service if the other parent cannot be located after a reasonable attempt.

  • Do I have to be married?

    The 17th Circuit Court requires that parties petitioning together must be married for 1 year.

  • What if I reside outside of Kent County but my child support case is in Kent County?

    The 17th Circuit Court requires that you file in the county in which you reside. Proof of residency is required, and filing is not dependent upon what county your Friend of the Court case is located.

  • Can I terminate parental rights without pursuing an adoption?

    The Adoption Department cannot assist with the termination of parental rights that is not the process of an Adoption case. Consult with an attorney for more information on the termination of parental rights.
